Terms of Service

These terms apply when you create a Burnt Beans account or use our service. By signing up, you agree to them. If anything here is unclear, write to us at hello@burntbeans.xyz before you sign up.
1. Who we are
Burnt Beans ("we", "us") provides digital loyalty cards for independent coffee shops, operated from London, United Kingdom. "You" means the business that creates an account; "customers" means the people who join your loyalty card.
2. The service
Burnt Beans lets your shop run a digital stamp card: customers join with their name and email address, staff add stamps by scanning the customer's QR code, and completed cards unlock the reward you have configured. Customers can optionally add their card to Apple Wallet.
3. Your account
- You must be authorised to act for the business you sign up.
- Keep your account details accurate and your login credentials confidential.
- You are responsible for activity that happens under your account, including by your staff.
- You must be at least 18 to create an account.
4. Subscriptions and billing
- The service is billed as a monthly subscription per shop, at the price shown when you sign up.
- Promotional pricing (such as a founding partner rate) applies for as long as your subscription remains active and continuous.
- You can cancel at any time; cancellation takes effect at the end of the current billing period and we do not offer partial refunds for that period.
- We may change pricing with at least 30 days' notice by email.
5. Your customers' data
Customer signups create a mailing list that belongs to you. For that list, you are the data controller and we process the data on your behalf. You agree to:
- use customer emails only in ways the customer has consented to;
- honour unsubscribe and deletion requests promptly;
- comply with UK data protection law (including UK GDPR and PECR) in any marketing you send.
6. Acceptable use
You must not use the service for anything unlawful, deceptive or abusive; attempt to interfere with or gain unauthorised access to the service; misrepresent your business; or use the service to send spam.
7. Availability and changes
We work to keep the service available and reliable, but we do not guarantee it will be uninterrupted or error-free. We may improve or change features over time, and may suspend access for maintenance or where we reasonably believe these terms have been breached.
8. Intellectual property
The service, its software and its design remain ours. Your shop's name, logo and branding remain yours — you grant us a licence to display them solely to operate your loyalty cards.
9. Liability
Nothing in these terms excludes liability that cannot be excluded by law. Otherwise, the service is provided for business use, our total liability to you in any 12-month period is limited to the fees you paid us in that period, and we are not liable for indirect or consequential losses such as lost profits or lost custom.
10. Ending the agreement
You can close your account at any time. We may terminate or suspend your account for material breach of these terms or non-payment, normally with prior notice. After closure, we will delete or return your customer list within a reasonable period, in line with our Privacy Policy.
11. Changes to these terms
If we make material changes we will give you notice by email or in the service. Continuing to use Burnt Beans after a change takes effect means you accept the updated terms.
12. Governing law
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
